1. Acceptance of Terms
By accessing or using the Track My Tour platform, website (trackmytour.in), and associated applications including the Driver App (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service.
2. Description of Service
Track My Tour provides a cloud-based tour management platform for tour operators, travel agencies, car rental companies, and related businesses in India. The Service includes booking management, CRM, fleet tracking, GST-compliant invoicing, driver management, vendor billing, analytics, and the AI assistant TARA.
3. Account Registration
- You must provide accurate, complete, and current information during registration.
- You are responsible for maintaining the confidentiality of your account credentials.
- You are responsible for all activities that occur under your account.
- You must be at least 18 years old to create an account.
- One person or business entity may not maintain more than one free account. Multiple accounts for the same entity require a paid subscription.
4. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose or in violation of any applicable laws or regulations
- Attempt to gain unauthorised access to any part of the Service or its related systems
- Interfere with or disrupt the integrity or performance of the Service
- Upload or transmit viruses, malware, or other harmful code
- Reverse engineer, decompile, or disassemble any part of the Service
- Resell, sublicense, or redistribute the Service without our written consent
- Scrape, data-mine, or use automated tools to extract data from the Service
5. Subscriptions & Payments
- Certain features of the Service require a paid subscription.
- Subscription fees are billed in advance on a monthly or annual basis as per the plan selected.
- All fees are quoted in Indian Rupees (INR) and are exclusive of applicable taxes (GST).
- We reserve the right to modify pricing with at least 30 days' prior notice. Price changes will take effect at the start of your next billing cycle.
- Refunds are processed in accordance with our refund policy and applicable consumer protection laws.
6. Your Data
You retain ownership of all data you upload to or create through the Service ("Your Data"). By using the Service, you grant us a limited licence to host, process, and display Your Data solely for the purpose of providing and improving the Service. We will not sell Your Data to third parties.
You are responsible for maintaining backups of Your Data. While we implement reasonable data protection measures, we are not liable for any loss of data.
7. Intellectual Property
The Service, including its design, features, code, content, trademarks, and logos, is owned by Track My Tour and is protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works of any part of the Service without our prior written consent.
8. Service Availability & Modifications
- We strive to maintain high availability but do not guarantee uninterrupted access. Scheduled maintenance will be communicated in advance where possible.
- We may modify, suspend, or discontinue any part of the Service at any time. We will provide reasonable notice for material changes that affect your use.
9. Limitation of Liability
To the maximum extent permitted by applicable law, Track My Tour and its directors, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising out of or related to your use of the Service.
Our total liability for any claim arising from or related to the Service shall not exceed the amount you paid to us in the twelve (12) months preceding the claim.
10. Indemnification
You agree to indemnify and hold harmless Track My Tour from any claims, damages, losses, or expenses (including legal fees) arising from your use of the Service, violation of these Terms, or infringement of any third-party rights.
11. Termination
- You may terminate your account at any time by contacting us or through your account settings.
- We may suspend or terminate your account if you violate these Terms or engage in fraudulent activity.
- Upon termination, your right to use the Service ceases immediately. We may retain Your Data for a reasonable period to comply with legal obligations.
12. Governing Law & Dispute Resolution
These Terms are governed by the laws of India. Any disputes arising from or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts in Bengaluru, Karnataka, India.
13. Changes to These Terms
We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last updated" date. Your continued use of the Service after changes constitutes acceptance of the revised Terms.
